Terms of Service

These Terms of Service ("Terms") govern your use of the WET Stake website and services provided by Prescott Farm Innovations LLC ("WET Stake," "we," "us," or "our").

1. Acceptance of Terms

By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Description of Services

WET Stake provides flood irrigation monitoring devices and related services. Our devices detect water presence and send notifications via text message or phone call. We also offer WET Level Monitor devices for monitoring water levels in storage tanks.

3. Account Registration

To use our services, you must:

  • Create an account with accurate, complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be at least 18 years old

4. Equipment Lease

WET Stake monitoring equipment is leased, not sold. Your use of the equipment is governed by our Equipment Lease Agreement, which is incorporated into these Terms by reference.

5. Subscription and Payment

  • Services are provided on an annual subscription basis
  • Fees are due upon invoice and are non-refundable once the service period begins
  • We accept credit cards and personal checks
  • A convenience fee may apply to credit card payments
  • Failure to pay may result in service suspension

6. Service Limitations

WET Stake is designed to assist with irrigation management and is NOT a flood prevention device. We do not guarantee:

  • Continuous, uninterrupted service
  • Detection in all conditions or scenarios
  • Cellular network availability
  • Prevention of water damage or crop loss

7. User Responsibilities

You agree to:

  • Use the equipment only for its intended purpose
  • Follow all installation and care instructions
  • Maintain accurate contact information for notifications
  • Not modify, reverse engineer, or tamper with equipment
  • Not use the service for any unlawful purpose

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WET STAKE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO CROP LOSS, WATER DAMAGE, LOST PROFITS, OR BUSINESS INTERRUPTION.

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the fees you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless WET Stake and its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

10. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of WET Stake or its licensors and is protected by copyright and other intellectual property laws.

11. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may cancel your service at any time by returning the equipment and contacting us.

13. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or our website. Continued use of our services after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho. Any disputes shall be resolved in the courts of Jefferson County, Idaho.
